If you do not agree, you must immediately cease using the platform. These Terms apply to all users, including students, freshers, employers, recruiters, institutes, and placement partners.
2. Eligibility & Account Registration
To use YellowPin, you must:
- Be at least 16 years old (or the legal age in your jurisdiction)
- Provide accurate, complete, and current registration information
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized access or security breach
YellowPin reserves the right to verify, suspend, or terminate accounts that provide false information or violate these Terms.
3. User Roles & Responsibilities
a) Talent (Students & Freshers)
- Provide accurate academic, skill, and professional information
- Apply only to positions matching your qualifications and intent
- Maintain professional conduct in all communications and interviews
b) Employers & Recruiters
- Post legitimate, non-discriminatory opportunities with clear terms
- Comply with all applicable labor, internship, and hiring laws
- Respond to applications professionally and within reasonable timeframes
c) Institutes & Training Partners
- Publish only verified, accredited, or industry-aligned courses
- Provide accurate curriculum, duration, and certification details
- Manage enrolments and learner communications responsibly
4. Platform Usage & Prohibited Activities
You agree not to:
- Misrepresent your identity, qualifications, or organizational affiliation
- Post fraudulent, misleading, or discriminatory job/course listings
- Spam, harass, or contact users outside platform-approved channels
- Reverse engineer, scrape, or extract platform data without permission
- Bypass payment structures, fees, or platform security measures
- Use the platform for any illegal, harmful, or unethical purpose
5. Nature of Services & Disclaimers
Platform Role: YellowPin acts as an intermediary ecosystem connecting talent, employers, and institutes. We do not guarantee job placement, internship approval, course completion, or career outcomes. All hiring, training, and onboarding decisions are made independently by the respective parties.
Job postings, course content, and event details are provided by third parties. YellowPin reviews content for compliance but does not endorse or assume liability for third-party accuracy, quality, or performance.
6. Intellectual Property Rights
All platform design, branding, software, APIs, and original content are the exclusive property of Aaditk IT Solutions Pvt. Ltd. and protected under Indian and international IP laws. Users retain ownership of their personal content but grant YellowPin a non-exclusive, royalty-free license to display, distribute, and promote it within the platform ecosystem. Unauthorized reproduction or commercial use of platform materials is strictly prohibited.
7. Data Privacy & Security
Your use of YellowPin is also governed by our Privacy Policy. By using the platform, you consent to the collection, storage, and processing of your data as described therein. We implement enterprise-grade security, encryption, and access controls to protect your information.
8. Fees, Payments & Refunds
Basic platform access for talent and institute discovery is free. Employers, recruiters, and premium event/course features may be subject to subscription or transaction fees as outlined in separate service agreements. All payments are processed securely through verified gateways. Refund policies are determined on a case-by-case basis and communicated at the time of purchase.
9. Termination & Suspension
YellowPin reserves the right to suspend or terminate your account immediately if you:
- Violate these Terms or our Community Guidelines
- Provide false, incomplete, or misleading information
- Engage in fraudulent, abusive, or illegal activities
- Receive valid complaints from other users or authorities
Users may delete their accounts at any time via platform settings. Upon termination, platform access ceases immediately, but relevant data may be retained for legal, compliance, or audit purposes.
10. Limitation of Liability
To the maximum extent permitted by law, YellowPin and its affiliates shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of data, income, opportunities, or business reputation
- Decisions made by employers, institutes, or talent based on platform content
- Service interruptions due to maintenance, third-party outages, or force majeure
Our total aggregate liability shall not exceed the amount paid by you to YellowPin in the preceding 12 months.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra. We encourage amicable resolution through mediation before initiating formal legal proceedings.
12. Modifications to Terms
YellowPin may update these Terms periodically to reflect platform changes, legal requirements, or service improvements. Significant changes will be notified via email, platform banner, or login prompt. Continued use of YellowPin after updates constitutes acceptance of the revised Terms.
